Privacy Policy

Empowering Communities with iM

This Privacy Policy describes how iM ("iM," "we," "us," or "our") collects, uses, and discloses information in connection with the websites located at https://imimmortal.life and https://app.imimmortal.life and the services offered through them (collectively, the "Service"). This Policy, together with our Terms of Service, governs your access to and use of the Service. By using the Service, you acknowledge this Policy and consent to the practices it describes. Capitalized terms not defined here have the meanings given in the Terms of Service.


1. Information We Collect

1.1 Account Information. When you register, we collect your name, email address, telephone number, and authentication credentials (passwords are stored in hashed form and are never accessible to us in plain text).

1.2 Recipient and Executor Information. The Service requires you to provide information about third parties: the names, relationships, email addresses, and mailing addresses of the beneficiaries you designate, and the names and email addresses of the executors you appoint. You represent that you have an appropriate basis to provide this information to us.

1.3 Your Content. We collect and store the content you create through the Service, including video recordings, written letters, transcripts and captions generated from your recordings, and the audio and text of your interactions with the Service's guided assistants (collectively, "Content").

1.4 Payment Information. Payments are processed by a third-party payment processor. Your full card number is transmitted directly to the processor and does not touch our servers; we retain only a truncated card reference (such as the last four digits) and transaction records.

1.5 Automatically Collected Information. We and our service providers automatically collect technical and usage information, including browser type, device information, language preference, referring pages, pages viewed, dates and times of access, IP address, and interactions with the Service, through cookies, pixels, SDKs, and similar technologies (see Section 6).


2. How We Use Information

We use the information described above to: (a) provide, operate, maintain, and secure the Service; (b) record, store, transcribe, caption, print, and deliver your Content according to your instructions, including following confirmation of your passing; (c) administer the check-in and executor-confirmation process; (d) process transactions; (e) communicate with you, including transactional messages that are integral to the Service (check-ins, reminders, receipts, executor communications, and delivery notices); (f) market and advertise the Service, including as described in Section 5; (g) produce aggregated or de-identified analytics that do not identify you; and (h) comply with legal obligations and enforce our Terms.


3. Delivery of Content After Your Passing

The purpose of the Service is to disclose your Content to the recipients you designate, on the schedule you select, after your passing has been confirmed through the Service's check-in and executor process. By creating and approving Content, you expressly direct us to make that disclosure. Prior to such confirmation, your Content is not made available to any recipient, beneficiary, or executor.



4. Disclosure of Information

4.1 Service Providers. We disclose information to third-party service providers that perform functions on our behalf — including payment processing, cloud hosting and storage, email transmission, commercial printing and mailing, speech synthesis, transcription, artificial-intelligence processing, and analytics — in each case limited to the information reasonably necessary for the provider to perform its function, and subject to obligations of confidentiality. Certain providers may process information outside your state or country of residence; by using the Service you consent to such transfers.

4.2 No Sale of Personal Information. We do not sell or rent your personal information. Our use of advertising and analytics cookies, described in Sections 5 and 6, may constitute "sharing" for cross-context behavioral advertising under certain state privacy laws; you may opt out as described in Section 9.

4.3 Legal Process and Protection. We may disclose information in response to a subpoena, court order, or other lawful governmental request, or when we believe in good faith that disclosure is reasonably necessary to protect the rights, property, or safety of iM, our users, or the public.

4.4 Business Transfers. If iM is involved in a merger, acquisition, financing, reorganization, or sale of assets, information may be transferred as part of that transaction, subject to this Policy or a successor policy.


5. Advertising and Remarketing

We may advertise the Service on third-party platforms, including search engines and social media, and we use remarketing services to present advertisements to individuals who have previously visited the Service. Third-party vendors, including advertising networks, may use cookies and similar technologies to serve advertisements based on your past visits to the Service. Advertising partners may combine this information with other information they hold. You may control how certain vendors advertise to you through those vendors' ad-preference tools, and you may opt out of interest-based advertising through your browser or device settings or through industry opt-out mechanisms. This Policy does not govern the practices of advertising partners, which are subject to their own privacy policies.


6. Cookies and Similar Technologies

We use cookies, local storage, and similar technologies to authenticate sessions, remember preferences, measure usage, and support the advertising described in Section 5. You may configure your browser to refuse cookies; if you do, portions of the Service may not function properly. Continued use of the Service without disabling cookies constitutes acknowledgment of their use.


7. Security

We employ commercially reasonable administrative, technical, and physical safeguards designed to protect your information, including hosting on secured cloud infrastructure, email-gated access to delivered Content, and segregation of payment data with our payment processor. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.


8. Retention

Because the Service exists to hold Content for delivery that may occur many years in the future, we retain Content and associated account information for as long as your account exists and delivery obligations remain outstanding. While living, you may edit or delete your Content, or request deletion of your account and associated data, by contacting us; deletion requests will be honored subject to legal retention requirements. Delivered Content remains available to recipients as part of the Service.


9. Your Choices and Rights

You may opt out of non-essential marketing email at any time via the unsubscribe mechanism in each message. Check-in communications cannot be disabled while your account holds undelivered Content, as they are the operative mechanism of the Service. Depending on your state of residence, you may have rights to access, correct, delete, or obtain a copy of your personal information, and to opt out of targeted advertising; to exercise these rights, contact us using the information in Section 13. We will not discriminate against you for exercising any privacy right.


10. Children

The Service is not directed to individuals under 18, and we do not knowingly collect personal information from children as account holders. Designated recipients may be of any age; Content is delivered to the contact information the account holder provides, and we recommend a parent's or guardian's email address for young recipients.


11. Third-Party Links

The Service may contain links to websites we do not operate. We are not responsible for the content or privacy practices of third-party sites and encourage you to review their policies.


12. Changes to This Policy

We may modify this Policy from time to time in our sole discretion. Material changes will be posted to this page with a revised effective date. Your continued use of the Service after a change becomes effective constitutes acceptance of the revised Policy.
